SETTLEMENT!!!
This is a brief update as Roger Orlando and David Karnas still are in Omaha after having completed a long drawn out process with legal counsel for ConAgra, traveling back to their respective homes today.
The largest group of cases in the country has been SETTLED.
All settled cases are folks in the "non-permanent injury" group (those folks who did not experience death, surgery, hospital stays of over 48 hours, reactive arthritis and the like.) The settlement recognizes the excellent science we put together very early on your behalf, and also, in contrast, recognizes the difficulties and expense involved in individual case proofs which would be necessary to bring your case in court. That is, in simple words, the settlement represents a compromise we reached with ConAgra in consideration of the pro's and con's of these cases.
A few important points to mention:
1. The global settlement sum is CONFIDENTIAL;
2. DO NOT CALL to ask how much your case is valued (we won't know
exactly yet);
3. A Special Master will be retained and asked to allocate client funds
per case;
4. "Permanent Injury" cases are exempted from this settlement and
continue to be advanced on individual merits;
5. We ARE SATISFIED with the sum ConAgra is paying to fund this
settlement (funds will be held in a special trust fund for eventual
disbursement); and
6. We expect allocation decisions (the net amount of money your case is
valued) and notices to be mailed out in the next 12 to 16 weeks.
NEW CLIENTS who have retained us after June 1st by referral of your law firm in Kentucky, as well as those individuals who have retained us simply by chance after June 1st, are NOT included in this settlement.
This settlement represents the culmination of a significant amount of work and dedication to you. We anticipate you will be pleased with the net results of this settlement. There is a lot more work we have to do but finally can show proof that the prior statements we have made to you that we have led all other groups in advancing your case toward a close were true.
Finally, while we are exhausted, for those weather channel junkies, note that we did dodge the tornados these last two days in Nebraska and Iowa!
