SETTLEMENT TALKS CONTINUE:
Settlement talks continue. These talks are occurring jointly (through the
MDL process) and within individual groups. However, these talks have not
been fruitful as yet. There remain two main reasons in our view: insurance
coverage issues and ConAgra seeks to isolate any particular group with
clients desperate enough to accept their - so far - "low ball" offers.
We cannot discuss actual or particular numbers, but there now have been a
number of settlements in the "couple hundred" dollar range. We also are
aware of one "larger" settlement, though in our view for a RIDICULOUSLY low
and unfair value. Hence, given this opinion, we cannot identify the lawyer,
client or specifics (it was in the Midwest). Certainly it wasn't us.
Although the saber rattling continues, we remain confident in the viability
of most of your cases and in our opinions as to a decent and fair value as
restitution to you for your illness and troubles.
While this case - less than a year old - actually has progressed fairly
rapidly in terms of what we have been able to accomplish, we do realize by
the volume of calls and emails we receive that some folks are getting
impatient. Please, while we never can guarantee any results, understand we
